In all Heka buildings, smoking is banned in common indoor areas, such as stairwells, saunas and club rooms, as well as playgrounds.
Smoking is banned inside apartments if the rental agreement for the apartment started on or after 1 June 2018. In rental agreements starting on or after 1 January 2021, the smoking ban also applies to balconies and terraces.
New and renovated properties are completely smoke-free if their construction or the renovations started after May 2016. In these buildings, smoking and electronic cigarettes are banned inside the apartments, on the balconies and terraces, and in common facilities.
If a tenant violates the smoking ban, they are in breach of agreement. In smoke-free buildings, cigarette smoke can be reported as a disturbance. The report must include the details of two witnesses. In minor cases, Heka will issue a notice and remind the tenant of the terms of their rental agreement. For a continuous or blatant breach of the smoking ban, Heka may issue a warning about the termination of the rental agreement. If even a warning is not effective, Heka may terminate or, in the worst case scenario, cancel the tenant’s rental agreement.

A tenant who violates the smoking ban must pay the repair costs of the damage caused when moving out. This is also laid down in the terms of the rental agreement. It is often necessary to clean and paint the apartment if someone smoked there. The costs of painting alone typically amount to several thousand euros. If smoking is permitted but it is disturbing you, you can submit a report about it by using the “Submit a notice of disruptive smoking” form on the Heka website. If the building’s structures do not prevent the smell or smoke from travelling and the tenant does not change their smoking habits, Heka may apply to the authorities for a smoking ban for the building.
